HoldEmTerms of service
These terms apply to the HoldEm app for iPhone, iPad and Android ("the app"), made by NFC.cool ("we", "us"). By using the app you agree to them. If you got the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies; if you got it from Google Play, the Google Play Terms of Service also apply.
1. A simulated card game, for adults
HoldEm is a simulated game of No-Limit Texas Hold'em for friends playing at the same real table. It is meant for adults: you must be at least 18 years old, or the age of majority where you live if that is higher.
2. Play chips have no value
The chips in HoldEm are play chips. They have no monetary value, cannot be bought, sold or transferred, and cannot be exchanged for money, prizes or anything else. HoldEm offers no real-money gambling and no prizes.
You may not use HoldEm to run, record or settle bets or games for money or anything of value. Where that kind of gambling is regulated, doing it is your own responsibility, and it is not a use we offer or allow.
3. Your licence
We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial play. You may not copy, sell, rent, reverse-engineer or redistribute the app, except where the law allows it regardless of these terms.
4. Purchases
The app is free. The shop offers cosmetic items, such as table looks, card backs, card faces, frames, reactions and all-in moves. They change how the table looks and sounds and never affect the cards, the odds or the outcome of a hand.
Purchases are made through the App Store or Google Play and are subject to their terms, including their refund rules; ask them for a refund. Items are tied to your App Store or Google Play account and can be restored on your other devices from the same account. We may change or retire items in future versions; if we remove one you bought, we will try to keep it working for you.
5. Playing fair
Do not use the app to harass anyone, and do not interfere with other players' devices or with the game, for example by tampering with the network traffic between the devices at a table.
6. The app as it is
We work hard to keep the deal fair and the chip counts exact, but the app is provided "as is". To the extent the law allows, we give no warranty that it will be free of errors or always available, and we are not liable for indirect or consequential losses, or for anything arising from using the app in breach of these terms. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.
7. Apple
If you use the app on an Apple device: these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance for it, and is not responsible for any claims relating to it. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
8. Changes
We may update these terms when the app changes. We will change the date above, and for significant changes we will say so in the app's release notes. If you keep using the app after a change, the new terms apply.
9. Law and contact
These terms are governed by the laws of Portugal. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim there. Questions about these terms: nfc.cool/contact.
